Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Profit Duck (the “Service”). By creating an account or using the Service, you agree to these Terms.

The Service

Profit Duck aggregates data from your point-of-sale, bank, and delivery platforms to provide sales, expense, tax, and forecasting reports for your restaurant business.

Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

Connecting third-party accounts

When you connect Square, your bank (via Plaid), or a delivery platform, you authorize Profit Duck to access and store the data needed to provide the Service. Your use of those third-party services remains subject to their own terms. You represent that you have the right to connect the accounts you link.

Cloud Sync (managed browser sessions)

If you enable Cloud Sync for a delivery platform, you authorize Profit Duck to sign in to that platform’s merchant portal on your behalf, using a browser session that runs on our servers, and to retrieve your business data on a schedule. Your delivery platform accounts remain governed by those platforms’ own terms, and you are responsible for your accounts with them. We may pause or limit syncs if a platform blocks or restricts this access. How credentials and sessions are handled is described in the Privacy Policy. You can disconnect a platform at any time from your settings.

Not financial, tax, or accounting advice

Profit Duck is an informational tool. The figures, tax estimates, forecasts, and reconciliation results it produces are provided for general informational purposes only and are not financial, accounting, tax, or legal advice. Estimates and projections are inherently uncertain and may differ from actual results. Always verify important numbers and consult a qualified professional (such as a CPA) before making financial, tax, or filing decisions. You are responsible for your own tax filings and compliance.

AI assistant

The Service includes an optional AI assistant. Its answers are generated with artificial intelligence, are provided for information only, and may be incomplete or wrong. Verify any number that matters before acting on it — the reports and pages in the Service, not the assistant’s replies, are the authoritative view of your data. Conversations are handled as described in the Privacy Policy. The assistant is optional: ask us and we’ll turn it off for your account.

Acceptable use

Don’t misuse the Service: no attempting to breach security or access other customers’ data, no reverse-engineering, scraping, or reselling the Service, and no unlawful use.

Fees

Founding customers receive the Service free for six months from account activation. After that period, the subscription price is $49 per month while the subscription remains continuously active.

Profit Duck will not charge you until you provide a valid payment method and expressly authorize recurring billing. If you cancel the Service, the founding rate ends. The current standard price outside the founding program is $77 per month.

We may change pricing for future customers, but we will not increase the $49 monthly founding rate for an active founding subscription.

Availability & changes

We aim for reliable service but do not guarantee it will be uninterrupted or error-free. We may modify, suspend, or discontinue features, and may update these Terms; continued use after changes constitutes acceptance. This does not let us raise the founding rate described in Fees: that rate stays fixed for any founding customer whose subscription remains active, regardless of later changes to these Terms.

Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Profit Duck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of your use of the Service.

Termination

You may stop using the Service at any time and request deletion of your data. You can download a full copy of your data from your settings at any time, before or after you stop. We may suspend or terminate access for violation of these Terms.

Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles.
